The heart of this lawsuit is about safety testing — or the lack of it.

The CDC’s Advisory Committee on Immunization Practices (ACIP) bases its recommendations only on short-term safety studies of individual shots. What they don’t study is the combined, long-term impact of giving so many vaccines together, dose after dose, year after year. Most states automatically adopt these ACIP recommendations into law, leaving families with almost no room for medical exemptions — especially in states like California, New York, Connecticut, and Maine, where exemptions are nearly impossible to get.

And when doctors speak up? They’re punished.

👉 Dr. Paul Thomas published research showing that children who followed the CDC’s full vaccine schedule had much higher rates of chronic illness. Within just five days of releasing his study, his license was suspended.

👉 Dr. Kenneth Stoller used genetic testing to identify children at greater risk of vaccine injury. For that, California’s medical board declared that only CDC guidelines could be followed — and they stripped him of his license, too.

The message is chilling: Conform, or face professional exile.

This lawsuit argues that such suppression of science and medical judgment is a violation of the First Amendment. Even if boards could punish doctors for dissenting opinions, the fact remains that these physicians are standing on actual data, while the CDC continues to enforce a “one-size-fits-all” model that has never been adequately tested for cumulative harm.

Another major piece of the lawsuit? It seeks to challenge the CDC’s universal “Category A” designation for almost every childhood vaccine. “Category A” means every child, no matter their individual health history, is expected to receive the shot. The alternative, “Category B,” allows for shared decision-making between families and doctors. Other countries like the UK, Japan, and 17 EU nations use this more flexible approach — and still maintain vaccination rates above 90%. So why is the U.S. clinging to such a rigid model that strips parents and doctors of choice?

The plaintiffs aren’t just asking for justice for themselves. They’re calling for a restoration of medical freedom, scientific integrity, and individualized care.

And there’s hope. Attorney Rick Jaffe, who’s leading this case, has a strong track record of standing up for doctors and patients. Some of the lawsuit’s allegations even echo concerns raised by Robert F. Kennedy Jr., who has been outspoken about the CDC’s failure to properly evaluate vaccine risks. Kennedy recently appointed a new slate of ACIP members who seem more willing to consider real data and admit that vaccines can and do cause harm for some children. That’s already a huge step forward compared to past administrations.

Could this lawsuit lead to meaningful reform? Maybe even a settlement that forces the CDC to overhaul its schedule? If so, it would be a historic victory for health freedom, informed consent, and truth.

Of course, the pushback has already started. The American Academy of Pediatrics (AAP) rushed to release their own so-called “independent” vaccine schedule, while still openly supporting the elimination of all non-medical exemptions in every state. Let’s not forget — pharmaceutical companies are among the AAP’s largest donors. That’s not independence; that’s conflict of interest.

This fight is far from over. But for the first time in a long time, it feels like the truth is breaking through.

Do you know where to find the list of ingredients for your routine childhood or adult vaccines? It’s located in Section 11 of the manufacturer’s package insert.

Most doctors will not give you the vaccine vial package insert, but it is available on the FDA website for review or printing. You can also find a list of all the ingredients, called excipients, on the CDC website. For a truly complete list, you’ll need to cross-reference the excipient table from the CDC with the ‘Components by Excipient’ table or the ‘Excipients in Routinely Recommended Vaccines’ table on the Johns Hopkins University (JHU) website. One table is organized by excipient, and the other by vaccine. These tables include a breakdown of the active ingredients, which were separated from the CDC’s original excipient table sometime between 2018 and 2021, when the updated list was published.

The package insert and the JHU list provide the exact measurements of the ingredients. For example, if you wanted to calculate the cumulative amount of aluminum in a specific vaccination schedule your child received, you could easily reference the CDC and JHU websites.

Do you know what the different types of ingredients in vaccines are used for and why they’re included? Either of the JHU tables breaks down the ingredients, their purpose, the type of vaccine they’re used in, what the vaccine targets, and the amount included in each dose. You’ll notice a variety of substances are used in vaccine formulation, ranging from stabilizers like sucrose and sodium chloride to residual mediums like human cell lines and animal cells. Additionally, antibiotics, aluminum adjuvants, and various toxins are included to provoke an immune system reaction.

HISTORY: Have you heard of the SV-40 cell line?

Some of the polio vaccines administered from 1955 to 1963 were contaminated with a virus called simian virus 40 (SV40). The virus came from the monkey kidney cell cultures used to produce the vaccine. Most, but not all, of the contamination was in the inactivated polio vaccine (IPV). Once the contamination was recognized, steps were taken to eliminate it from future vaccines.

1. WI-38 cell lines originating from human fetal lung tissue are no longer used, as noted in the CDC 2018 excipient list, but MRC-5 is still widely used.

2. There are no ingredients listed for the COVID vaccine on the latest CDC Excipient list dated 11-1-2021. However, lipids & stabilizers are listed in the JHU list. What about the other ingredients, including the mRNA technology or Spike Proteins? Additionally, when were the COVID shot Package Inserts released? Comirnaty says it was updated 10-2024.

3. The CDC excipient list isn’t updated annually, as it should be, since formulations for the flu vaccine change annually. How can we truly be getting informed consent when the list isn’t complete or updated?

Vaccines do not undergo the same rigorous pre-licensure safety reviews as pharmaceutical drugs & other biologics. Unlike drugs & other biologics, the FDA does not require vaccines to undergo long-term, double-blind, inert saline placebo-controlled trials—widely regarded as the Gold Standard of safety testing.

The Difference Between Pharmaceutical Drugs & Biologics

1. Traditional Drugs (Compounds): These are typically small molecules synthesized through chemical processes. They are often referred to as "compounds" because they are chemically defined and consist of specific molecular structures.

2. Biologic Drugs: Biologics are large, complex molecules or mixtures of molecules produced by living organisms. They include proteins, antibodies, vaccines, gene therapies, and cell therapies. Since biologics are derived from biological systems and not purely chemical synthesis, they are not always referred to as "compounds" in the same way small-molecule drugs are. Instead, terms like "products" or "agents" are more commonly used.

What Are Vaccines?

Vaccines are a type of biologic drug specifically designed to stimulate the immune system to recognize and combat pathogens such as viruses or bacteria. They differ from traditional pharmaceutical drugs in how they are made, regulated, and function. Here’s a breakdown:

• Definition: Vaccines are biological preparations that provide immunity against specific diseases. They work by introducing antigens (weakened, killed, or parts of pathogens) to "train" the immune system to recognize and fight the pathogen in the future.

• Purpose: Prevention of diseases, rather than treatment like traditional drugs.

Types of Vaccines

1. Live Attenuated Vaccines: Contain weakened forms of the pathogen (e.g., measles, mumps, rubella).

2. Inactivated Vaccines: Contain killed pathogens (e.g., polio, hepatitis A).

3. Subunit, Recombinant, or Conjugate Vaccines: Contain parts of the pathogen, like proteins (e.g., HPV, whooping cough).

4. Messenger RNA (mRNA) Vaccines: Teach cells to make a protein that triggers an immune response (e.g., COVID-19 vaccines).

5. Viral Vector Vaccines: Use a modified virus to deliver genetic material that produces an immune response (e.g., some COVID-19 vaccines).

What Vaccines Are Not

Vaccines are not chemical compounds like small-molecule drugs. Instead:

• They are biologics, meaning they are produced from living cells or organisms (e.g., bacteria, yeast, or mammalian cells).

• Their active components (like proteins or genetic material) are large and complex, making their structure much harder to define and replicate compared to chemical drugs.

Key Differences Between Vaccines and Other Biologics

While all vaccines are biologics, not all biologics are vaccines. For instance:

• Vaccines: Prevent diseases by priming the immune system.

• Other Biologics: Include therapies like monoclonal antibodies, blood products, and gene therapies, which may treat or manage existing conditions.

Differences in FDA Licensing for Vaccines and Other Biologics

All non-vaccine drugs licensed by the FDA undergo long-term, multi-year, double-blind safety studies. These studies compare the rate of adverse reactions in the group receiving the drug to a group receiving an inert placebo, such as a sugar pill or saline injection. However, vaccines are generally not tested against inert placebos. In fact, only two vaccines in history (HPV, COVID-19) have ever been tested with a saline placebo, and none have undergone long-term safety studies.

While most drugs are administered to sick adults, vaccines are typically given universally to healthy babies, toddlers, or, in some cases, the very elderly. And while pharmaceutical companies remain liable for injuries caused by their non-vaccine drugs, as discussed in another section, they have no liability for injuries caused by their vaccines.

One would, therefore, expect that pre-licensure safety testing for vaccines would be more rigorous than that conducted for non-vaccine drugs. Which isn’t the case.

Since my article, “Vaccine Commercials Are Exempt from Disclosures,” was written in 2021, there have been some important updates regarding vaccine advertising on TV and radio, particularly in light of the COVID-19 pandemic. Here's a breakdown of the key changes:

Vaccine Advertising and the Emergency Use Authorization (EUA):

Vaccines that are authorized under the EUA (Emergency Use Authorization) are subject to specific advertising rules. Under the EUA, the FDA allows vaccines to be distributed without the usual full approval process, but this doesn't necessarily exempt them from disclosure requirements in advertisements. Advertisements for vaccines under the EUA do not need to provide the same level of detailed side effect information that pharmaceuticals might (remember that vaccines are classified as biologics, not pharmaceuticals), but the FDA does require that the ads include a prominent disclaimer that the vaccine is authorized under the EUA.

For example, a commercial or public service announcement (PSA) for COVID-19 vaccines might say, "This vaccine has not been approved or licensed by the FDA but has been authorized for emergency use by the FDA."

Updated Rules for TV and Radio Commercials:

In the past, vaccines were treated differently from pharmaceutical drugs in terms of side effect disclosures in ads. After all, they are classified as biologics, not pharmaceuticals. While drugs (pharmaceuticals) are subject to detailed disclosures, vaccine ads have been more lenient, focusing more on benefits and not required to list every possible side effect unless there is a significant concern.

However, due to the nature of the COVID-19 vaccine rollouts, there have been clearer regulations on how information must be presented, especially with the EUA status. Ads promoting COVID-19 vaccines must inform viewers about the potential side effects and direct them to resources (e.g., the CDC or FDA) for additional information.

The FDA and FTC (Federal Trade Commission) have provided advertisers with guidance about what can and cannot be said in these ads. The key point is that any COVID-19 vaccine advertisement must be truthful, not misleading, and must balance the benefits and potential risks.

COVID-19 Vaccine Commercials:

Since the FDA granted Emergency Use Authorization for the COVID-19 vaccines, vaccines were advertised primarily through public service announcements (PSAs) rather than traditional marketing by pharmaceutical companies. The U.S. government invested heavily in these PSAs to promote vaccination, and they have been widespread across TV and radio, often encouraging people to get vaccinated for the public good.

As for the lack of commercials for COVID-19 vaccines (in late 2020 or early 2021) by pharmaceutical companies in the traditional sense (like those for other vaccines or drugs), this is largely because of the government-funded nature of the vaccine distribution. Vaccines were provided at no cost to consumers, funded by taxpayer dollars, and manufacturers typically were not marketing them like a regular product. The U.S. government (not pharmaceutical companies) took the lead in the messaging and campaign.

Additionally, there was a shift in the early stages of the pandemic towards public health messaging, rather than commercial-style ads, focusing on widespread vaccine acceptance. This trend has been due in part to government mandates and public health initiatives.

Current Regulatory Landscape:

Since 2021, the full approval of COVID-19 vaccines (e.g., Pfizer and Moderna) under the FDA’s Biologics License Application (BLA) has changed the regulatory landscape for vaccine advertisements. Now, FDA-approved vaccines fall under the same advertising regulations as other approved biologics, meaning any ad must include a more comprehensive list of potential side effects and contraindications.

For TV and radio ads, this could mean a greater emphasis on risk communication for the now FDA-approved COVID-19 vaccines, although ads for these vaccines will still tend to focus more on the benefits and accessibility of vaccination.

Summary of Changes:

• COVID-19 Vaccine Advertising: Initially, under EUA, vaccine ads were not required to include detailed side effects, but clear disclaimers about EUA status had to be included.

The Hidden Cost of Big Pharma: How Advertising Trumps Research

Have you ever wondered how much Big Pharma really invests in innovation versus promotion? According to the British Medical Journal (BMJ), for every $1 that pharmaceutical companies spend on "basic research," they spend an astonishing $19 on advertising and promotions. That’s not just a financial imbalance—it speaks to a much larger issue of priorities, where patient care and scientific advancement often take a back seat to persuasion and profit.

Big Pharma's Marketing Power
Pharmaceutical companies don’t just rely on television commercials or print ads. They wield significant influence over media outlets as well, and the scope of their reach is both vast and subtle. For instance, in 2018, it was estimated that 70% of all news advertising in the U.S. came from pharmaceutical companies. That’s right—over two-thirds of the ads that appear during our evening news broadcasts are sponsored by Big Pharma. This staggering number is indicative of the way these companies use their resources to shape public perception, influence medical professionals, and drive consumer demand for specific drugs.

The pharmaceutical industry’s grip on media extends into other areas, too. A study by Fierce Pharma found that TV advertising remains the cornerstone of Big Pharma's marketing strategy. In 2020, pharma TV ads alone amounted to $4.58 billion, making up 75% of their total ad spend. This is up from 73% in 2019, indicating a continued reliance on television as the primary tool to promote their products.

The True Impact on Doctors and Patients
It's not just the general public that’s affected by this overwhelming marketing machine—healthcare providers are, too. A study published in The Journal of Clinical Oncology revealed some troubling findings. In their survey, 94% of nurse practitioners reported that patients had requested a drug they saw advertised on TV. Even more concerning, 74% of those same practitioners said that patients had asked for drugs that were not appropriate for their condition. Worse still, over half of those requests resulted in a prescription being written, even when it may not have been the best option for the patient.

What does this mean? It means that advertising isn’t just influencing patients—it’s influencing doctors as well. When patients come into a doctor’s office with a specific drug in mind, the pressure is on healthcare providers to meet those demands, sometimes at the expense of better, more appropriate treatment options.

The Growing Ad Spend
And the problem doesn’t seem to be slowing down. In 2023 alone, the pharmaceutical preparations industry in the U.S. spent a whopping $15.58 billion on advertising—up from $12.83 billion in 2022. That’s a 21% increase in just one year. This continued rise in ad spending speaks volumes about where the pharmaceutical industry’s priorities lie. While research and development of new treatments are undoubtedly important, the reality is that Big Pharma is sinking more and more money into convincing doctors and patients to choose their products rather than investing in the kind of research that would genuinely benefit public health.

The Dangers of Misleading Advertising
Perhaps the most insidious aspect of Big Pharma’s advertising is its ability to mislead. According to data from Drugwatch, 57% of claims made in drug advertisements were potentially misleading, and 10% were entirely false. This is not a small issue—it’s one that directly impacts the decisions of both patients and healthcare providers. When advertising is not just persuasive but deceptive, the consequences can be severe, resulting in patients being prescribed medications that aren’t in their best interest.

Is It Time for Change?
So, what’s the solution? While we can’t completely shut down Big Pharma’s marketing machine, there’s certainly room for reform. Stricter regulations on drug advertising, particularly on TV and in other media, could help level the playing field. Healthcare providers and patients also need to be more informed about the pressures created by these advertisements. The truth is, while a flashy TV ad might convince a patient to ask their doctor about a certain drug, it doesn’t necessarily mean that drug is the right choice for their health.

As individuals, we can start by questioning the ads we see and reading between the lines of pharmaceutical messaging. But systemic change will require more than just awareness—it will require a shift in how we value research versus promotion in the healthcare industry. Until that happens, Big Pharma’s spending priorities will continue to shape the way we approach medicine, and not necessarily for the better.

Conclusion: A Call for Transparency
The rise of Big Pharma’s marketing budget should concern all of us. Not because advertising in itself is bad, but because it reveals where priorities are placed. Too much money is being funneled into marketing strategies designed to sell products rather than into research that might genuinely improve public health. The next time you see a drug commercial on TV, remember the facts: for every dollar spent on research, $19 goes into convincing you—or your doctor—that a particular drug is the solution.

The Open Payments website is a federal program that promotes transparency in healthcare by collecting data on payments from drug and medical device companies to physicians. Its public database includes payments for travel, research funding, gifts, speaking fees, meals, and tracks any ownership interests that doctors or their immediate family members hold in these companies.

While most physicians receive payments averaging around $193, these sums accumulate significantly over time. For example, from August 2013 to December 2015, Genentech, Inc.—the pharmaceutical company behind drugs like the allergy medication Xolair and the antiviral Tamiflu—paid a staggering $727 million to doctors and research hospitals. These substantial payments underscore the extent of financial influence that some pharmaceutical companies wield within the medical community. Financial incentives, whether in the form of direct payments or through support for research and educational events, raise questions about potential conflicts of interest and their impact on patient care.

The Open Payments website can provide valuable transparency, but there is growing concern about the underreporting of certain payments and relationships. Some payments, especially those made indirectly or through third-party organizations, may not be fully disclosed. I have personally heard from healthcare professionals who shared that they received dinners, gifts, and trips that were never reported. Additionally, there are gaps in reporting when smaller payments or certain kinds of gifts go unrecorded. These issues can limit the site’s ability to show a complete picture of the financial relationships between healthcare providers and the pharmaceutical or medical device industries.

Did You Know? While COVID-19 was the third leading cause of death in 2020, a 2016 analysis published in the BMJ (formerly the British Medical Journal) reported that medical errors claim the lives of 251,000 Americans each year. This places medical errors above causes like accidents, strokes, respiratory disease, and Alzheimer’s in the leading causes of death—surpassed only by heart disease and cancer. Remarkably, in 2024, this statistic remains consistent, with articles still reporting this alarming figure.

The term medical error typically refers to a preventable adverse event (negative outcome) that was caused by an error, such as the administration of the wrong medication. However, the term is also used to include all adverse events rather than just those caused by a health worker’s error, such as an allergic reaction to a medication. While the vast majority of errors are not fatal, errors causing death have been used as a proxy for the magnitude of the problem of medical error.

The field of health safety aims to minimize medical errors. Because most medical errors should, at least theoretically, be preventable, it is understandable why the patient safety movement has grown in recent years.

Moreover, medical errors have a high cost, with some experts estimating adverse events costing the healthcare system $20 billion each year and others approximating healthcare costs of $35.7 to $45 billion annually for hospital-acquired infections alone. Medical errors also negatively impact the patient, their family, involved clinicians and support staff, the healthcare facility, and the community.

Did you know? Pediatricians are entirely exempt from liability for any vaccine-related injury, even if it occurs in their own office, administered by their own hand, and directly in front of them. Many are not trained to recognize vaccine injuries beyond anaphylaxis, so numerous vaccine injuries go undiagnosed, untreated, and unreported. However, if a pediatrician does not adhere to vaccination standards and fails to promote them, they can then be held legally liable and may face lawsuits.

Our federal government passed a law back in 1986 that vaccine manufacturers are not liable for damages caused by their vaccines (if prepared correctly). So, if your child has a reaction to their shots, the makers are fully exempt from any sort of lawsuit. This law also includes hospitals, clinics, pharmacists, doctors, nurses, and drive-through clinics.

The National Childhood Vaccine Injury Act mandates that nurses, doctors, clinics, and hospitals report vaccine reactions to the Vaccine Adverse Event Reporting System (VAERS). However, many reactions go unreported. When our doctor refused to report our reactions—a legal obligation—it left me with the option of filing a complaint with our state medical board. This lack of reporting is not just a violation of the law; it also hampers the system's ability to ensure patient safety and make informed health policy decisions.

This lack of liability takes on even greater significance when we consider Talking Point #19, which reveals that the medical system itself ranks as the third leading cause of death in the United States.

Did you know many pediatricians do not practice informed consent when administering vaccines?

Many pediatricians today do not fully practice informed consent when administering vaccines. This means parents may not always receive comprehensive information about the risks, benefits, side effects, and ingredients before vaccines are given.

The principle of informed consent is rooted in The Nuremberg Code, a 10-point statement designed to define the ethics & limits of permissible medical experimentation on human beings. It was developed in August 1947 in Nürnberg (Nuremberg), Germany, by a panel of American judges during hearings involving 23 Nazi doctors accused of conducting experiments on humans in concentration camps during World War II. One of its key points is the voluntary, informed consent of human subjects, emphasizing that individuals must fully understand what they are agreeing to.

The 10 points of the Nuremberg Code are:

1. Voluntary consent of the human subject in the experimentation is absolutely essential.

2. The study's results should yield meaningful results that benefit society, be unprocurable by other methods or means of study, and not be random or unnecessary in scope and nature.

3. Any experimentation should be designed and based on the results of animal experimentation, taking into consideration the knowledge of the natural history of the issue under study that the results will justify the completion of the experimentation.

4. The methods used in the study should be conducted to avoid any unnecessary physical or mental suffering or injury to the subjects or subjects taking part in the study.

5. No experimentation should be conducted where there is a prior reason to believe that disabling injury or death will occur, with the exception being if the experimental scientists conducting the study also serve as subjects in the study.

6. The degree of risk that subjects of the study undertake should never exceed the risk determined by the humanitarian importance of the issue under study.

7. All proper preparations should be made, and proper facilities provided to protect the subject or subjects of the study against any possibility of injury, disability, or death.

8. All experiments should be conducted by persons qualified to do so. Through all stages of the experiment, all possible efforts should be taken to ensure the highest degree of skill and care are maintained.

9. At any point during the experiment, every human subject should be permitted to bring the experimentation to an end should the subject deem that they have reached the point where continuation of the experiment appears to the subject to no longer be possible.

10. As the experiment progresses, the scientist in charge must be in a state of mind that, should they deem that the continuation of the experiment could result in injury, disability, or death to the subject, the experiment will be terminated.

Informed consent isn’t just a historical concept—it’s essential today, especially regarding medical interventions like vaccinations. Before any medical treatment, including vaccines, patients have the right to be informed about all potential risks and benefits. Unfortunately, many doctors do not provide this information adequately, often only offering a simplified Vaccine Information Statement (VIS) instead of the full package insert, which contains much more detail.

When I asked our pediatrician for the full vaccine package insert, I was initially refused. After some persistence, I finally received the inserts weeks later. This experience highlights the importance of being proactive and insisting on full transparency from healthcare providers.

As the American Medical Association states, "Patients have the right to receive information and ask questions about recommended treatments so they can make informed decisions." It's crucial for parents to exercise this right and ensure they are comfortable with any medical treatment their child receives.

Were you fully informed about your child's vaccine risks and benefits? Don't hesitate to ask for detailed information and make decisions that align with what's best for your family. Things to consider in becoming fully informed:

• What is the risk of getting the disease I’m getting vaccinated for?

• How many people die per year from that disease?

• What are the benefits of getting the vaccine?

• Can I still catch the disease if I get the vaccine?

• Is it a live virus vaccine that sheds?

• What are the side effects?

• Did I review the clinical trials?

• How long was the clinical trial held?

• What are the ingredients? Are they safe?

• Do you know what to do if you have a reaction?

• Do you know how to report a reaction?

Did You Know? Vaccination is a medical intervention performed on a healthy person that has the inherent ability to result in the injury or death of that healthy person. Because of this risk, you have choices. You have a right to refuse vaccinations and request an exemption for school or work.

To obtain a vaccine exemption for your child to attend school or for yourself as an adult, you must follow the regulations outlined in your state’s vaccine law. These laws vary from state to state. Below are the different types of vaccine exemptions used in various states throughout the U.S. The 4 types include philosophical exemption, religious exemption, medical exemption, or proof of immunity.

Medical Exemptions: All 50 states allow medical exemption to vaccination. In most states, a medical exemption must be written by a medical doctor (M.D.) or doctor of osteopathy (D.O.). Some states also allow other state-designated health care workers to certify that the administration of one or more state mandated vaccines would be detrimental to the health of an individual. Most states do not allow a doctor of chiropractic to write medical vaccine exemptions.

*Medical Exemptions Difficult to Get - A medical exemption to vaccination is very difficult to obtain because almost all medical reasons for delaying or withholding vaccines have been eliminated by government and medical trade officials. Most doctors and health care workers follow federal vaccine recommendations published by the Centers for Disease Control (CDC) outlining what is and is not considered a medical contraindication to vaccination. Some states will accept a doctor’s written medical vaccine exemption without question. Other states allow state public health officials to review and reject the medical exemption written by a medical doctor or other state-designated health care worker if health department officials don't think the exemption is justified or because it does not conform to federal (CDC) vaccine contraindication guidelines.  **See bottom for California

Religious Exemption: The constitutional right to have and exercise personal religious beliefs, whether you are of the Christian, Jewish, Muslim, or other faith, can be defended. Constitutionally, Americans have an expectation that their religious beliefs will be respected and that government will not pass laws that obstruct the exercise of this most fundamental of freedoms.

If you exercise your right to religious exemption to vaccination, you must be prepared to defend it and explain your religious or spiritual beliefs in your own words. The religious exemption is intended for people who hold a sincere religious belief opposing vaccination to the extent that if the state forced vaccination, it would be an infringement on their constitutional right to exercise their religious beliefs. A state must have a "compelling State interest" before this right can be taken away. Limiting the spread of serious communicable diseases has been defined as a "compelling State interest" in court cases after the 1905 U.S. Supreme Court decision Jacobson v. Massachusetts affirmed the right of states to mandate smallpox vaccine.

In a number of state court cases setting precedent on the issue of vaccine mandates, the freedom to act according to one’s religious beliefs is subject to reasonable regulation, if exercise of personal religious beliefs substantially threatens the welfare of society as a whole. State requirements for religious exemption can vary widely state to state and below are examples of how religious exemption may be defined in your state and what may be required to obtain a religious exemption to vaccination:

1) The exemption’s definition may be broadly defined to include philosophical, personal or conscientiously held beliefs not necessarily tied to an organized religion.

2) Membership in an organized religion that has written tenets prohibiting invasive medical procedures such as vaccination. However, this kind of language has been ruled unconstitutional when it has been challenged in State Supreme Courts.

3) A signed affidavit from your pastor or spiritual advisor from the church you attend.

4) Notarization of your signature on a religious exemption statement attesting to your sincerely held religious beliefs about vaccination.

As of 2023, all U.S. states allow a religious exemption to vaccination except California,  Maine, New York, and West Virginia. Prior to registering your child for school, you should check your state law to verify what proof is needed if you intend to file an exemption for sincerely held religious or spiritual beliefs. 

If you belong to a church, consider educating the head of your local church about the sincerity of your personal religious beliefs regarding vaccination. You may be able to obtain a letter from your pastor, priest, rabbi, or other spiritual counselor affirming the sincerity of your religious beliefs and file it along with any statement you may be required to write explaining your religious or spiritually held beliefs about vaccination. 

Philosophical, Conscientious or Personal Belief Exemption: This type of exemption is for individuals who hold conscientious objections to one or more vaccines. Less than half of U.S. states allow for an exemption to vaccination based on philosophical, personal or conscientiously held beliefs. To learn if your state offers this type of exemption, please visit NVIC’s State Law & Vaccine Requirements webpage.

Each state's requirements for this exemption vary greatly from state to state. In some states parents or children old enough to give consent (usually age 12 or older) must object to all vaccines and not just one vaccine. In Washington and Oregon, parents seeking a personal belief exemption must first obtain a signature from a medical doctor or other state-designated health care worker in order to file the exemption or may be required to complete a state vaccine education program (Oregon). 

While the term "conscientious objector" is generally associated with someone who refuses to serve in the military due to matters of conscience, according to the College of Physicians of Philidelphia it was The British Vaccination Act of 1898 that created a vaccine exemption based on conscienctious objections that gave rise to this popular term.

Proof of Immunity: Some state laws allow individuals to be exempted from vaccination or re-vaccination if proof of existing immunity for certain diseases can be shown. If a person has recovered from the natural disease or has been vaccinated, a blood titer test may indicate that there are enough naturally acquired or vaccine-acquired antibodies to “prove” immunity to a particular disease. Private medical laboratories can perform the blood titer test and measure the level of antibodies and provide you with a report that you can submit with the request for an exemption if the antibody titers are high enough according to accepted standards. A blood titer test that measures antibody levels can cost $55 or more, depending on the disease.

**CALIFORNIA RESIDENTS:

Students will need to provide immunization records to their schools before entry, and schools will still need to report to the California Department of Public Health (CDPH) the immunization status of all students at the existing checkpoints of child care, kindergarten, and 7th-grade.

In 2011 AB-499 Minors: medical care: consent was passed

AB-499 allows minors 12 years old and older to consent to vaccines for sexually transmitted diseases without the knowledge or consent of their parents.  This includes HPV vaccine.

In 2015, Governor Jerry Brown signed SB 277 (Pan)

which removed philosophical and religious exemptions, leaving only medical exemption and proof of immunity through blood titer testing. “Effective one year from now, in July 2016, SB 277 will eliminate personal and religious exemptions from immunization requirements for children in childcare and public and private schools.”

The following exempt categories will not have to meet existing immunization requirements for entry:

1) Home-based private schools

2) Students enrolled in an independent study program who do not receive classroom-based instruction

3) Special education services specified in an individualized education program.

SB 277 does allow philosophical and religious exemptions from any new immunization requirement initiated by CDPH for school and childcare attendance. In other words, if the CDPH introduces a new vaccination requirement to attend school, families can then use the philosophical or religious exemption. For instance, since the Covid vaccine was added to the CDC schedule after 2016, families can use any exemption.

In 2019, Governor Gavin Newsom signed SB 276 & SB 714 (Pan)

Beginning January 1, 2021, all new medical exemptions for school and child care entry must be issued through the California Immunization Registry - Medical Exemption website (CAIR-ME)​. Medical exemptions can only be issued by MDs or DOs licensed in California and must meet applicable Centers for Disease Control and Prevention (CDC), Advisory Committee on Immunization Practices (ACIP), and American Academy of Pediatrics (AAP) criteria.

Parents can create an account in CAIR-ME and apply for an exemption. They will receive an exemption application number to give to their child’s physician. The physician can register for an account in CAIR-ME and log in to issue the medical exemption.  Once the medical exemption is issued, the physician prints the form and provides a copy to the parents to give to their child’s school or childcare facility.

What is antibody titer blood testing? An antibody titer blood test is used to determine if you had previous infections and whether or not you need certain immunizations. This test analyzes the presence and measures the number of antibodies in a person's blood, which can be produced either as a response to past infections or through vaccinations. Vaccines stimulate the immune system to create specific antibodies, providing protection against certain diseases. Therefore, the results of an antibody titer test can help assess both past infections and the effectiveness of vaccinations.

Why is this important? Vaccines can lose their effectiveness over time, which is why booster shots are recommended. However, by getting an antibody titer test, you can avoid unnecessary vaccinations and the potential exposure to excess toxins. The term "titer" refers to the concentration of an antibody, determined by finding the highest dilution at which the antibody can still cause agglutination (the clumping of particles) of the antigen.

Where can you get this test? Anyone can request this simple blood test from their primary care physician or an immunologist to check their antibody levels.

Our doctor refused to conduct titer testing for our daughter and pressured us into vaccinating our child for kindergarten, which led to further health issues, toxicity, and yet another hospitalization. We later learned from the school nurse that titer testing is a fully acceptable alternative to vaccination for school entry, provided the titers are at the appropriate levels. So why did our doctor refuse us?

Antibody titer blood testing is especially valuable for those children who:

• do not qualify for an individual education plan (IEP)

• children who carry the MTHFR gene or have methylation issues.

One of the most shocking pieces of information I discovered during my research is that the dosage for certain vaccines, such as the flu shot and Hepatitis B vaccine, is the same for adults and infants. For instance, my 5-pound baby received the same dosage of the Hepatitis B vaccine just a few hours after birth as a grown 19 year old man would receive.

Here is an example from the Flu Shot package insert: FLUARIX QUADRIVALENT is approved for use in persons aged 6 months and older. Ages 6 months through 8 years of age receive one or two doses, 0.5 mL each. If 2 doses, administer at least 4 weeks apart. Ages 9 years of age and older receive one dose, 0.5 mL.

Do you know how many shots your child received before their first birthday? What about before they turned 18 years old?

When my daughter Scarlet was born, we adhered to the CDC’s recommended vaccination schedule provided by her pediatrician. By her first birthday, she had received 25 doses of 8 different vaccine antigens, often getting as many as 8 antigens in a single visit.

Today, the CDC schedule recommends administering up to 37 doses of 16 different antigens to babies aged 12 to 15 months. These antigens include Hepatitis B, Rotavirus, Diphtheria, Tetanus, Pertussis, Hib, Pneumococcal, Polio, Flu, Measles, Mumps, Rubella, Varicella, Hepatitis A, Covid, and now RSV.

By the time children reach age 6, they can expect to receive an additional 22 doses of vaccines, bringing their total to 59 doses. This includes 7 boosters administered between 15 months and 6 years old for diphtheria, tetanus, pertussis, polio, influenza, COVID-19, measles, mumps, rubella, and varicella, along with the addition of hepatitis A.

By the time children reach age 18, they can expect to receive an additional 34 vaccine doses, including 12 annual flu shots and 12 annual COVID boosters. This brings their lifetime total to 93 doses, covering 19 different antigens. Once children reach age 11, they become eligible for the HPV and Meningococcal vaccines and transition from the DTaP shot to the TDaP shot, which is used for adults.

Contrary to common belief, deaths from infectious diseases in the U.S. decreased by 85-90% before vaccines were introduced. This trend was also observed in diseases that lacked vaccines, such as scarlet fever, tuberculosis, cholera, and typhoid. The decline in mortality rates was primarily attributed to advancements in modern sanitation systems, including clean water, electricity, sewage systems, and trash collection.

It’s amazing how washing our hands with soap and water helps combat the spread of infectious diseases. In addition, having access to toilets means we don’t have to walk through human waste in the streets. We can cook and refrigerate our food and properly dispose of trash, keeping rats, bugs, and diseases at bay.

How is this possible? The pharmaceutical and medical industries have spent millions convincing us that vaccines are the primary reason we overcame these diseases. However, history suggests this narrative is more of a marketing tactic than a fact—one that helped sustain the nearly $60 billion vaccine market in 2022.

Consider these additional talking points:

• Smallpox was eradicated in the U.S. in 1949, and vaccination was subsequently discontinued. This is the only instance in history where a disease has been eradicated through vaccination in humans. However, this claim is debatable; some argue that improved handwashing and sanitation practices may have also played a significant role in its eradication.

• While polio has not been 100% eradicated, the type of polio that is currently spread is not wild polio but rather vaccine-derived polio, resulting from vaccine shedding.

• None of the diseases we currently vaccinate against have been fully eradicated. Consider the flu, COVID-19, whooping cough, and others. Do these vaccines truly work?

• All vaccines carry the risk of side effects. How can you know if you or your child will be among those who experience a bad reaction? Remember the cupcake analogy.

So, it begs the question… Did vaccines really save us?
